A Productivity Commission Research Paper dated February 2015 on Australia’s International Tourism Industry observed about short term rentals laws, that:

In New South Wales, local councils have the power to set rules pertaining to short-term letting of houses and apartments, subject to compliance with state planning policy.

The report also includes a heading titled "There is confusion about the legality of short-term residential letting."

There are 38 local councils in Greater Sydney, and taking two councils as examples, there are laws which apply to traditional Bed and Breakfasts:

Airbnb concedes that hosts are ultimately responsible for ensuring they met all local requirements, and despite this, Airbnb use in Sydney has increased despite regulations protecting the residential nature of our neighbourhoods and the threat of fines from local councils.

Calls to open up to the sharing economy from Australian politicians mirror the same pleas to de-regulate "the sharing economy" by Airbnb and its venture-backed corporate lobbyists.

An Airbnb host can setup a calendar for their listing so that it is only available for a few days or weeks a year.

Other listings are available all year round (except for when it is already booked).

Entire homes or apartments highly available year-round for tourists, probably don't have the owner present, could be illegal, and more importantly, are displacing residents.
